Do you have any more info on the suit AG? Like what is BM llc. seeking? Just to have the masters destroyed or what? My inclination would be to sue the pants off of them and put them out of business - but then I was born and raised in LA - I'm still learning not to be so vindictive and paranoid. Then again thinking about it now, I bet they made alot of money off of those tapes, perhaps that money could be put into BRC; infrastructure, art project funding etc. (more trailers for DPW ...)

I gathered from the text in the article that they were given the opportunity to cease voluntarily before the suit was filed, is that correct?

It [the suit] seeks damages and an injunction against further sale or display of the pictures.
Seems clear enough. Go get 'em, say I. I hope the damages will cover the costs, but this needs to be pursued even if it costs some.

And participants need to keep an eye out for those long lenses during the event. Seems like they oughta be pretty conspicuous to those in the area of the camera, even if they're too far away for the women being photographed to notice. Have to speculate on what sort of intervention would be appropriate upon discovering such an operation . . .

i'm not *that* larry harvey. i'm a different larry harvey.

i like, but i'm bothered by the distinction of "invasions of privacy for commercial use" vs. invasion of privacy for any other reason.

the text on the back of the ticket has made it pretty clear that you *don't* have an expectation of privacy with regards to cameras, and it seems a bit duplicitous to turn that around and use it in a law case.

imagine finding out you're a porn star but you don't seem to remember saying 'yeah sure! take pictures of naked me and make it available to everyone that wants to wack off to it and hey, while you're at it, might as well make some money off it too!'

bad enough the peeping tom's who have no respect, worse, profiting from it and knowing that anyone can see you naked anytime they want by popping over to the corner video store

No, no, no. Sure, I understand the sentiments. They're the same ones that allowed folks to stand around while someone was being lynched for what to the assembled group was a good very reason.

Would you support some working stiff, who used to be employed by Enron (or Adlephia or Worldcom), if he took a bat and commited some "street justice" on the corporation's executive staff? Sure, it's a tempting idea to support such activity, but where does it stop? Someone cuts me off in traffic and Mr. Baseball Bat and I do a tap dance on the other driver's car and him (if he'd be foolish enough to exit the vehicle)? What if the guy being beaten whips out his .38 and pumps a half a dozen bullets into the attacker's chest? Odds are that he would receive a judgement of justifiable homicide and then he'd go after the assets of the estate in a civil proceeding.

Let the courts do their thing. The alternative is unthinkable.

To AG: Full support for Burning Man LLC's taking action and seeking an injunction. Hope you can get any profits they may have made, drive them out of business as well as seeking punitive damages from them. You go, BMLLC!

I honestly don't think anyone would actually beat them, it's just a nice thought . . .

I think if anyone spots a character doing this, grab a ranger to take care of the situation . . .

as for the cash: use it of course for the costs of having the event and if there's any left over, bring an ice-cream truck full of ice-cold popsicles! but only disclose the location of it to the people that read about it here . . .
or better yet, just e-mail it to me . . .

The text on the ticket is supposed to indicate that Burning Man has the right - not the responsibility, but the option - to act as a representative for individual participants whose privacy might be impacted as a result of a violation of our camera policies at the event.

But it is not to say that if you're naked at Burning Man there's no way your image will never be captured on film. We do, however, maintain controls over how any imagery at Burning Man - naked or no - is distributed. It's a private event, and all cameras are tagged and filming is only by permission. These guys didn't have it.
