Connecticut cleaner faces jail time for
illegal dumping
On May 28, Michael Rosenberg was sentenced
to 18 months in prison for pleading guilty to illegally dumping
two drums of perc in the woods near Farmington, CT.
Rosenberg, who owned Avenue Cleaners in
Naugatuck, CT, between 1995 and 1999, was charged with two
counts of violating the Resource Conservation and Recovery Act
and plead guilty in March of 2001.
The 18-month prison sentence will be
followed by a three-year term of supervised release (United
States v. Rosenberg D. Conn., No. 3:01CR73, 5/28/02). In
addition to the prison sentence, U.S. District Court Judge
Christopher F. Droney deferred an order of restitution.
Rosenberg will still likely face fines of
more than $200,000 to various cover clean-up costs associated
with the dumping.
Back in March of 2000, two drums of perc
marked with Avenue Cleaners’ labels were discovered
dumped and spilling near the Farmington, Connecticut Reservoir,
according to the U.S. attorney’s office. Although the
reservoir was no longer used as a drinking water source, the
wells of two local homes had been contaminated with the waste,
according to U.S. Attorney John Danaher III.
Danaher also noted that the drycleaning
business located in Naugatuck, CT has been under new management
since late 1999 and there is no evidence to suggest any more
improper handling or disposal of perc.
The case was investigated by EPA’s
Criminal Investigation Division and the Environmental Crime
Unit of the Connecticut Chief State Attorney’s Office,
with additional assistance from the Connecticut Department of
Environmental Protection and the Town of Farmington Police
Department.
