Virginia death tax legislation passes in
Senate and House
The Virginia inheritance tax is close to
being repealed.
The MidAtlantic Association of Cleaners worked on the issue alongside a statewide
coalition of small businesses, preservation groups and
professional and business organizations.
The association believes a repealed death
tax will greatly benefit smaller, family-owned businesses,
including many of the state’s drycleaning establishments.
On February 12, the Senate of Virginia and
House of Delegates both approved legislation to repeal the
state’s death tax with votes of 28-12 and 67-30
respectively. If Governor Warner signs the bill into law, the
death tax will be repealed as of January 1, 2004.
Senator Thomas K. Norment, R-James City,
is the patron of SB 1123 and Delegate Bob Tata, R-Virginia
Beach, is the patron of HB 2490 along with Delegate Bob
McDonnell, R-Virginia Beach.
Currently, Virginia collects as much as 16
percent of an estate’s value in taxes. Prior to the
passage of federal inheritance tax repeal legislation, the
Virginia levy had no impact on taxpayer’s estates because
they received a dollar-for-dollar credit on their federal
returns.
Under the legislation passed by Congress
in 2001, the federal credit is in the process of being phased
out. Additionally, more than 30 states are simultaneously
phasing out their death taxes.

death tax issue, visit www.legis.state.va.us.
